Creator marketing agency briefs in Glasgow and Birmingham: retail and public sector

How creator marketing agency work in Glasgow and Birmingham differs for public sector and retail briefs, from procurement routes to advertising rules.

Same brief, two buying systems. A creator marketing agency pitching in Glasgow and one pitching in Birmingham may be asked for identical deliverables — creators, content, usage, reporting — but the route from brief to signed contract runs through different rules. This article sets out how public sector and retail briefs differ between the two cities: the procurement routes Scottish public bodies use, the approval chain behind a West Midlands retail campaign, the disclosure rules that apply to the content, and the items that should appear in every written brief. It covers briefs and buying routes, not agency rankings.

Glasgow: creator work bought through Scottish public sector procurement

Scottish public bodies buy communications and campaign services under Scottish procurement rules (Public sector procurement, gov.scot). Opportunities are advertised on Public Contracts Scotland, the national portal for Scottish public sector contracts, and above-threshold notices also appear on the UK's Find a Tender service.

The framework is set by the Procurement Reform (Scotland) Act 2014, which places a sustainable procurement duty on contracting authorities, and by the Public Contracts (Scotland) Regulations 2015, which govern procedure for above-threshold contracts, including the standstill period. Scotland Excel, the local government procurement body, runs national frameworks that councils can call off.

The clients are recognisable. Glasgow City Council, NHS Greater Glasgow and Clyde and Strathclyde Partnership for Transport are among the public bodies in and around the city that let contracts through those routes. The city region also holds consumer brands: A.G. Barr is based in Cumbernauld and Tunnock's in Uddingston.

Scotland Excel publishes its current frameworks in an online catalogue, so check it for marketing and creative services before assuming a route exists. Procurement thresholds are reset every two years, so read the current figures on gov.scot rather than relying on a number quoted elsewhere. Under the Scottish regulations, the standstill period is at least 10 calendar days when notices are sent electronically.

For a creator campaign, two procedures dominate: a call-off from an existing framework for marketing or creative services, or a mini-competition among the suppliers on that framework. Both fix the specification and the award criteria before you submit, which is why the brief has to be complete on first reading.

What the contract notice tells you

  • The procedureopen, restricted, framework call-off or mini-competition.
  • The award criteria and their weightings, set out in the tender documents.
  • The deadline for clarifications and where the answers are published, usually to all bidders through the portal.
  • The contract length and, where the notice states one, the value band.
  • Any specification covering accessibility, plain English or evaluation against a funder's outcomes.

What a Glasgow public sector brief should contain

  • The outcome being funded, in the funder's own words.
  • The creator profile, with any local or language requirements.
  • Deliverables, formats, captions and subtitles.
  • Evaluation and reach reporting, tied back to that outcome.
  • Usage period and exclusivity, with rights written as their own lines.
  • Named approvers and the point at which content is signed off.
  • A realistic launch date. A standstill period applies before an above-threshold contract is entered into, so a campaign should never be dated from the day the award is announced.

How a Glasgow retail brief is approved

A Glasgow retail or consumer-brand brief usually runs in sequence. Brand marketing signs off the idea and creator list, legal or compliance checks claims and disclosure wording, and the retailer or stockist approves any in-store use. The ASA's CAP Code applies in Scotland exactly as in England, so the disclosure checks are the same as in Birmingham.

Birmingham: retail and FMCG approval runs in parallel

Birmingham sits at the centre of a West Midlands client base that includes national retailers, wholesalers and food, drink and household manufacturers; the Cadbury works at Bournville is the long-standing example. Approval here is spread across teams that review at the same time rather than in sequence — brand marketing, legal, and trading or customer teams — with the retailer's own marketing and buying functions added when content is destined for a store promotion or a retailer's media network.

A creator marketing agency on a retail brief will usually see usage and exclusivity handled as separate commercial lines. That is where the campaign's rights are actually defined: usage and exclusivity terms should say where the content can run, for how long, and whether paid media or whitelisting is included.

Disclosure is not optional. The CAP Code, written by the Committee of Advertising Practice and enforced by the Advertising Standards Authority, requires marketing communications to be obviously identifiable as advertising, and the Competition and Markets Authority has published guidance for influencers on making paid relationships clear. When a script implies a personal recommendation, the ASA and CAP Code rules are the first check for an England-focused campaign.

Speed is the reward for a complete brief: brand, legal and trading reviewers can clear a creator list together when the claim, the disclosure wording and the rights are stated up front rather than negotiated later.

Public sector work in the city is thinner but real. Birmingham City Council and local NHS bodies such as University Hospitals Birmingham NHS Foundation Trust and Birmingham Women's and Children's NHS Foundation Trust buy communications and campaign services under English procurement law. Since 24 February 2025 that is the Procurement Act 2023 for new procurements. Contracts started earlier continue under the Public Contracts Regulations 2015.

Notices appear on Find a Tender and, below the threshold, on Contracts Finder. After an award decision, the Procurement Act 2023 requires a standstill of at least eight working days before the contract is signed. Crown Commercial Service runs cross-government frameworks, including its Communications Marketplace, that many public bodies use when they need a call-off route.

The same brief, judged on the same evidence

Strip the process back and a brand is comparing the same things in both cities: what is being bought, who approves it, when the content can run, and what proof of delivery comes back. The difference is the sequence and the paperwork, not the creative.

Whichever city you are briefing in, compare agency business models on one campaign unit before you compare anything else, and judge competitors on delivered work and dates rather than on the wording of a credentials deck.

A brief checklist that works in both cities

  • The contract or framework reference, and the portal the opportunity came from.
  • The outcome or commercial objective, written in one sentence.
  • Deliverablesnumber of assets, formats, aspect ratios, captions.
  • Creator profile, and any local, language or accessibility requirements.
  • Disclosure routehow the advertising is labelled, and who signs it off.
  • Usage period, territory, paid media and whitelisting rights, each priced as its own line.
  • Exclusivity, and what it prevents the creator from doing elsewhere.
  • The approval chain, with named approvers and a decision date.
  • Reportingwhat will be measured, and by whom.
  • The schedule through award, standstill and campaign start.

Common questions

Do Glasgow agencies charge less than Birmingham agencies?

Agency rates are not published in either city, so the question is settled on one written scope. Put creative, production, creator fees and rights on a single page, using the same unit of work, and compare like with like. A day rate and a project fee are not the same unit.

Can an agency in one city bid for work in the other?

Yes, in both directions. Scottish public sector procurement does not restrict bidders by location, and English retail campaigns are bought privately. For a public sector brief, ask for the contract notice reference and read the selection criteria before you commit.

Where are the opportunities published?

Public Contracts Scotland carries Scottish public sector notices; Find a Tender carries UK notices above the threshold; Contracts Finder publishes lower-value opportunities in England. If the brief is a call-off, ask the authority which portal and which framework it will use.

What does a standstill period mean for my campaign dates?

After an above-threshold award decision, the authority observes a standstill before entering the contract. Book creators and launch dates for after the contract is signed, not after the award is announced.
