Part of Influencer agencies strategy: evidence and approval gates

Influencer agencies planning template: rule and tax rows for England

Complete the rule and tax rows of an influencer-agency planning template for England: jurisdiction, CAP Code, PECR, HMRC tax guidance and a named adviser.

The England row of a planning record is easy to fill with a vague entry such as "UK law". A usable row names the jurisdiction, the rules that apply to the asset, the tax questions and the person who decides each one. Leave a field blank when the advertiser lacks evidence.

What to take away

  • England operating context is the England and Wales legal jurisdiction, plus consumer law, VAT, corporation tax, PAYE and off-payroll working.
  • Cite advertising rules by number, so a reviewer can check the actual asset against them.
  • A company record identifies a party. It does not prove a creator mandate or delivery capability.
  • Tax gets its own rows, cited to HMRC guidance, and a named accountant or tax adviser, not a share of one bundled cost.
  • Every financial row carries a reconciliation field.

What the England context row must contain

England operating context means the England and Wales legal jurisdiction and consumer law under the Consumer Protection from Unfair Trading Regulations 2008 and the Consumer Rights Act 2015. It also covers UK VAT, corporation tax, PAYE and off-payroll working. Enter each as a separate line.

Decision card fields

  • Verified governance problem and source
  • Advertiser legal entity and England context
  • Product, objective and intended population
  • Proposed asset, channel and review period
  • Agency-managed choice and baseline
  • Decision owner, spend authority and date

The context row sits on the decision card, whose entries the figure lists. Most of these rules apply across the whole UK. The England-specific entry is the jurisdiction line, England and Wales. A blank is safer than a plausible-looking assumption, so a line the buyer cannot support stays empty and the item stays on hold until someone supplies the evidence.

One register for rules, sources and owners

The register gives each rule its own row. The middle column names what to cite, and the last column says what the buyer must still supply, because a citation alone does not clear a row.

Citing advertising and marketing rules

Cite the rule by number so a reviewer can test the asset against it. For advertising recognition, CAP Code rules 2.1 and 2.3 apply. For misleading claims and substantiation, CAP Code rules 3.1 and 3.7 apply.

The ASA/CAP influencer resource collection is a useful UK starting point, but the buyer still needs review of the actual content. How the advertising rules treat recognition, claims and placement is covered separately, and the template only records which rule applies to which asset.

ICO guidance on direct marketing and PECR regulations 6 and 22 set the UK rules for cookies and electronic marketing. PECR regulation 22 applies to the transmission of unsolicited communications by electronic mail to individual subscribers. The wider data protection questions for audience uploads sit in their own row.

What a company record can and cannot enter

Companies House public company information can help identify an incorporated UK party, but it cannot prove a creator mandate or delivery capability. The parties line therefore needs authority evidence from another source, with limits, an approving person and an expiry.

Companies House does not verify the accuracy of filed information and cannot confirm trading status, solvency or beneficial ownership. A clean search result is an identity check and nothing more. If the template shows a green tick for "company verified", it claims more than the record supports.

Tax rows and the reconciliation field

Give tax its own rows rather than folding it into one campaign figure. Each financial row should state currency, VAT basis, unit, quantity, period, quote date, payee, payer, inclusions, exclusions and approval status.

HMRC administers all four taxes, so each tax row cites its HMRC guidance and names the adviser who confirms it.

GOV.UK explains that VAT is a tax added to most products and services sold by VAT-registered businesses. That is general UK information. A named accountant or tax adviser must determine the specific treatment and recoverability, and the template records who that person is and when they confirmed it.

Add a reconciliation field linking the approved line to the contract, purchase order and invoice. The blank budget template supplies the columns, and the hidden costs checks list what a quote may leave out.

Review dates and expiry

Record the date each rule row was last reviewed and by whom. Approval expires when the asset, claim, creator, audience, platform function, supplier, contract or data flow changes, so a changed asset reopens every row that cites it.

The rows feed the release gates described in the strategy guide. Until those gates are cleared, the record stays a plan and not a permission to publish.

Before you act

  • Write England and Wales as the jurisdiction and give each rule its own row.
  • Cite CAP Code rules 2.1, 2.3, 3.1 and 3.7 against the actual asset.
  • Record whether PECR regulations 6 and 22 touch any cookie or electronic marketing.
  • Name the accountant or tax adviser for VAT, corporation tax, PAYE and off-payroll.
  • Add a reconciliation field to every financial row.

Common questions

What does the England operating context row cover?

It covers the England and Wales legal jurisdiction and consumer law under the Consumer Protection from Unfair Trading Regulations 2008 and the Consumer Rights Act 2015, plus UK VAT, corporation tax, PAYE and off-payroll working. Each gets its own line, left blank where evidence is missing.

Can a Companies House entry stand in for a creator's authority?

No. Public company information can help identify an incorporated UK party, but it cannot prove a creator mandate or delivery capability. It also does not confirm trading status, solvency or beneficial ownership, so authority needs its own record.

Who decides the VAT treatment of a cost line?

A named accountant or tax adviser must determine the specific treatment and recoverability. GOV.UK material is general information. The template records the adviser's name, the confirmation date and the reconciliation link to the contract, purchase order and invoice.
